By accessing or using the website at waipahuinsulation.com (the "Site"), or by requesting or receiving services from Waipahu Insulation("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use this Site or our services.
These Terms apply to all visitors to the Site and to all customers who engageWaipahu Insulation for insulation services. For service-specific agreements, any written contract or signed estimate supersedes these Terms to the extent of any conflict.
Waipahu Insulation provides residential and commercial insulation services in Waipahu, HI and surrounding Oahu communities. Services include, but are not limited to, spray foam insulation, attic insulation, blown-in insulation, crawl space insulation, vapor barrier installation, air sealing, and related work.
All services are subject to an in-person assessment and written estimate. We reserve the right to decline any project that we determine falls outside our scope of work or that we cannot complete safely and to a professional standard.
Estimates provided by Waipahu Insulation are based on information available at the time of the site assessment. A written estimate is valid for 30 days from the date issued unless otherwise noted.
Prices may be adjusted if conditions discovered during the work differ materially from those observed at the time of the estimate - for example, concealed damage, hazardous materials, or structural access issues not visible during the initial walkthrough. We will notify you before proceeding with any work that falls outside the original scope and obtain your authorization before incurring additional costs.
All prices are in U.S. dollars. Hawaii state general excise tax applies to all services as required by law.
Once you accept an estimate and a start date is agreed upon, you are confirming your intent to proceed with the work. We reserve the right to charge a cancellation fee for jobs cancelled with less than 48 hours notice, particularly where materials have already been ordered or staged for your project.
We will provide reasonable notice if we need to reschedule due to weather, crew availability, or other circumstances beyond our control. We ask that you do the same. If your schedule changes, please contact us as early as possible so we can accommodate other customers.
Payment terms are specified in the written estimate or contract for each project. In general, a deposit may be required before work begins on larger projects. The remaining balance is due upon completion of the work unless otherwise agreed in writing.
Invoices not paid within 30 days of the due date may be subject to a late fee. We reserve the right to pursue collection of unpaid balances through appropriate legal channels. You are responsible for any reasonable collection costs or attorney fees incurred in recovering an overdue balance.
Waipahu Insulation warrants that all work will be performed in a professional and workmanlike manner, consistent with industry standards for insulation work in Hawaii. If you believe work was not completed as agreed, contact us promptly so we can assess the issue and make it right.
Except as expressly stated in a written warranty provided with a specific project, our services are provided "as is." We do not warrant specific outcomes such as particular reductions in energy costs, indoor temperature levels, or moisture readings. Results vary based on your home's age, construction, and other factors outside our control.
Manufacturer warranties on materials - such as spray foam products - are separate from our workmanship warranty and are subject to the manufacturer's own terms. We will provide documentation for any product warranties that apply to your project.
To the fullest extent permitted by applicable law, Waipahu Insulation shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of our website or the services we provide. This includes, but is not limited to, lost savings, loss of use, or property damage not directly caused by our negligence.
Our total liability to you for any claim arising out of a specific project shall not exceed the amount you paid us for that project. Nothing in these Terms limits our liability for personal injury caused by our negligence or for fraud.
The content on this Site - including text, images, and other materials - is provided for informational purposes. We make reasonable efforts to keep the information accurate and up to date, but we do not warrant that all content is complete, current, or free of errors.
You may not copy, reproduce, or republish content from this Site for commercial purposes without our written permission. Personal, non-commercial use is permitted.
If a dispute arises between you and Waipahu Insulation relating to our services or these Terms, we ask that you contact us directly first and give us a reasonable opportunity to resolve the matter. Most concerns can be addressed quickly through a direct conversation.
If direct resolution is not possible, the parties agree to attempt to resolve the dispute through good-faith mediation before initiating any formal legal proceedings. Each party shall bear its own mediation costs unless otherwise agreed.
These Terms and Conditions are governed by the laws of the State of Hawaii, without regard to its conflict of law principles. Any legal proceedings arising out of these Terms shall be brought in the appropriate state or federal courts located in Hawaii, and you consent to the personal jurisdiction of those courts.
We reserve the right to update or modify these Terms at any time. When changes are made, we will update the effective date at the top of this page.
